These terms apply when you use the Giga Driver apps or this website, or buy a Giga Driver plan. Please read them. Section 16 says that disputes go to individual arbitration, not to court, and not as a class action.
1. This agreement
Giga Driver is made by an independent developer in the United States (“we”, “us”). These terms are an agreement between you and us. They cover the Android app, the iPhone app and this website.
When you create an account, start a trial or buy a plan, you agree to these terms. If you do not agree, do not use Giga Driver.
Our privacy policy explains what we collect and why. The store where you buy a plan has its own terms too: Whop’s Buyer Terms for a plan bought on our website, Apple’s terms for the App Store, and Google’s terms for Google Play.
2. Who can use Giga Driver
You must be at least 18 years old. You must follow the laws where you drive and the terms of each delivery or rideshare app that you use.
3. What Giga Driver does and does not do
Giga Driver reads the offers that delivery and rideshare apps show on your screen and shows a grade for each offer, based on your goals.
- A grade is a suggestion. You decide which offers to accept. Giga Driver never accepts or declines an offer for you.
- Giga Driver can read an offer wrong, read it late, or miss it. It does not promise any amount of earnings.
- Giga Driver is in beta. Which apps, offer types, phones and system versions it supports can change. Some phones and app versions do not work. Check that it works on your phone during your trial.
- Keep your eyes on the road. Do not use your phone in a way that is not safe or not legal while you drive.
4. Your account
You sign in with Google, Apple or your phone number. Keep your sign-in safe. You are responsible for what happens in your account.
You can delete your account at any time. Deleting your account ends a plan bought on our website at once, with no refund for the days that are left. It does not cancel an App Store or Google Play plan. Cancel those with Apple or Google.
5. Plans and payment
Giga Driver needs a paid plan or an active trial. Where you buy the plan decides who charges you:
- On our website, also when the app opens our website’s checkout: Whop (whop.com) handles the payment and charges your card.
- In the iPhone app: Apple charges your Apple Account.
- In the Google Play app: Google charges your Google Play payment method.
Before you pay, the checkout shows the price, how long each period is and, for a trial, the date of the first charge. Prices can differ by store and by country. Taxes can apply.
6. Free trials
Some plans start with a free trial. The checkout shows how many days it lasts.
- A trial that asks for a card or a store payment method becomes a paid plan when it ends. The first charge is on the date that the checkout showed. To not be charged, cancel before the trial ends.
- A trial that you start by verifying your phone number asks for no card. It ends by itself and charges nothing.
- Each person, card and phone number can get one free trial. We can refuse or end a trial when we think it is being misused.
7. Automatic renewal
Every paid plan renews automatically at the end of each period, at the price then in effect, until you cancel. When you buy a plan or start a trial with a card, you let the store charge your payment method for each period until you cancel.
8. How to cancel
You can cancel at any time. Cancel where you bought the plan:
- Plan bought on our website: gigadriver.app/plan, or your Whop account.
- App Store plan: on your iPhone, Settings > your name > Subscriptions. Cancel at least 24 hours before the plan renews.
- Google Play plan: in the Play Store app, Profile > Payments & subscriptions > Subscriptions.
When you cancel, you keep access until the end of the period you paid for, or until the end of your trial, and you are not charged again. Deleting the app from your phone does not cancel a plan. If you cannot cancel, email us before the renewal date and we will cancel it for you.
9. Refunds
Plans bought on our website: payments are not refundable. This includes the first charge after a trial, a renewal that you forgot to cancel, a period you did not use, and the days left when you cancel or delete your account. The only exception is where the law where you live requires a refund.
If you live in the European Union, the European Economic Area or the United Kingdom, you may have a legal right to withdraw from a purchase within 14 days. These terms do not take away any right that the law gives you.
If a charge is wrong (for example, a double charge, or a charge after you cancelled), email us and we will fix it.
App Store and Google Play plans: Apple and Google decide refunds under their own rules. Ask them for a refund.
Please contact us before you dispute a charge with your bank. Most problems are faster to fix by email.
10. Failed payments and price changes
If a payment fails, your access stops until the payment goes through. There is no grace period.
We can change the price of a plan. Before a new price applies to your plan, we or the store tell you. The new price starts with your next period. If you do not agree, cancel before then.
11. Rules for using Giga Driver
Do not:
- Copy, sell, share or rent Giga Driver or your account.
- Take the apps apart, copy how they read offers, or try to get their code, except where the law allows it.
- Get around the paywall, trial limits or other limits, or use more than one account to get more trials.
- Use Giga Driver to break the law or another company’s terms.
- Attack, overload or interfere with our servers.
12. Other companies’ apps
Giga Driver is not part of, made by or approved by DoorDash, Uber, Lyft, Instacart, Grubhub or any other company whose app it reads. Their names belong to them. When they change their apps, Giga Driver can stop reading their offers until we update it. You are responsible for following their terms.
13. Changes to the service and ending access
We can add, change or remove features. We can suspend or end your access if you break these terms or misuse Giga Driver. If we stop Giga Driver completely, we stop charging for it.
14. No warranty
Giga Driver is given “as is” and “as available”. To the extent the law allows, we give no warranties, including that it will work without errors or breaks, read every offer correctly, or suit your purpose.
15. Limit of liability
To the extent the law allows, we are not liable for lost earnings, missed or wrong offers, accounts suspended by other companies, or indirect or consequential damages. Our total liability to you is limited to the amount you paid us for Giga Driver in the 12 months before the claim, or US$50, whichever is more. Some places do not allow these limits, so they may not apply to you.
16. Disputes and arbitration
Please read this section carefully. It changes how a dispute between you and us is settled.
- Talk to us first. Before you start a claim, email us your name, your account email and what you want. We both try to settle it for 30 days.
- Arbitration. If we cannot settle it, the dispute goes to final and binding individual arbitration under the Federal Arbitration Act. The American Arbitration Association runs it under its Consumer Arbitration Rules. A judge or jury does not decide it.
- Small claims. You or we can bring an individual claim in small claims court instead, if it qualifies.
- No class actions. You and we bring claims only for ourselves, not as a plaintiff or member in a class, group or representative action.
- Your right to opt out. You can opt out of this arbitration section within 30 days after you first agree to these terms. Email us that you opt out, with your name and account email.
These terms are governed by the laws of the State of California and United States federal law, except where the law where you live gives you rights that cannot be taken away.
17. Changes to these terms
We can change these terms. The date at the top shows the last change. For an important change, we tell you in the app or by email before it applies. If you keep using Giga Driver after a change applies, you agree to the new terms.
If a translation of these terms differs from the English text, the English text applies. If a court finds that a part of these terms cannot be enforced, the rest still applies.
